Terms of Service
These terms govern your use of qredpilot.com and the QredPilot AI voice services provided by NexQred Fintech Private Limited (“NexQred”, “we”, “us”). By using the website or our services, you agree to these terms. If you are using QredPilot for an organisation, you confirm you are authorised to accept them on its behalf.
1. About these terms
These terms apply to everyone who visits our website. If your organisation signs a separate order form or master services agreement with us, that agreement governs the paid services, and these terms fill in anything it does not cover. If the two conflict, the signed agreement wins.
2. Using the website
- Use the website only for lawful purposes and in line with these terms
- Give accurate information when you contact us or book a demo
- Do not try to disrupt, overload, scrape or gain unauthorised access to the website or our systems
- Do not submit content that is unlawful, misleading or infringes anyone’s rights
Demo audio, transcripts and figures on the website illustrate how QredPilot works. They are not a guarantee of specific results for your business.
3. Our services
QredPilot provides AI voice agents that make and receive calls, qualify and verify customers, capture information and trigger follow-up actions for financial institutions. The scope, service levels, languages and integrations for each client are set out in their order form or agreement. We may improve or change features over time, and we will not materially reduce the services a client has paid for during their term without notice.
4. Client responsibilities
Clients who use QredPilot to contact their customers are responsible for:
- Having a lawful basis and any required consent to contact each person and process their data
- Complying with RBI directions, the Digital Personal Data Protection Act, 2023, TRAI telemarketing rules (including DND preferences and calling hours) and fair practices codes for lending and recovery
- Approving the scripts, offers and workflows their agents use, and making sure they are accurate and not misleading
- Keeping their account credentials and API keys secure
Clients may not use QredPilot for harassment, abusive or coercive recovery practices, fraud, impersonation or any unlawful purpose. We may refuse or stop campaigns that breach these rules.
5. AI-generated output
QredPilot uses AI to understand speech and generate responses, transcripts, summaries and scores. AI output can occasionally be inaccurate or incomplete. Clients remain responsible for decisions they make using it, including credit, underwriting and collections decisions, and should keep appropriate human review and escalation in place. Our agents identify calls as automated or recorded where required.
6. Intellectual property
The QredPilot name, logo, website, software, models and documentation belong to NexQred or its licensors. Nothing in these terms transfers them to you. Clients keep ownership of their own data, including their customer data, call recordings and transcripts, and grant us the rights needed to provide the services. If you send us feedback, we may use it to improve QredPilot without obligation to you.
7. Fees
Fees, billing cycles and payment terms for paid services are set out in each client’s order form. Unless stated otherwise, fees are exclusive of GST and other applicable taxes. Overdue amounts may lead to suspension after written notice.
8. Confidentiality and data protection
Each party will keep the other’s confidential information private and use it only to perform its obligations. We handle personal data as described in our Privacy Policy and, for client call data, as a data processor under our agreement with the client.
9. Disclaimers
We work to keep QredPilot reliable, secure and accurate. Except as expressly set out in a signed agreement, the website and services are provided “as is” and “as available”, and we do not warrant that they will be uninterrupted or error-free. Telephony networks, third-party systems and internet connectivity outside our control can affect call quality and availability.
10. Limitation of liability
To the extent permitted by law, NexQred is not liable for indirect, incidental, special or consequential losses, or for loss of profits, revenue, data or goodwill. Our total liability arising from the services in any 12-month period is limited to the fees the client paid us for those services in that period. For use of the website alone, our total liability is limited to ₹10,000. Nothing in these terms limits liability that cannot be limited by law.
11. Suspension and termination
We may suspend or end access to the website or services if these terms are seriously breached, if required by law or a regulator, or to protect our systems or other users. Clients may end their services as set out in their agreement. On termination, we will return or delete client data as agreed, subject to legal retention requirements.
12. Governing law and disputes
These terms are governed by the laws of India. The parties will first try to resolve any dispute in good faith. If it is not resolved within 30 days, the courts of India will have exclusive jurisdiction, unless a signed agreement specifies arbitration or a particular seat.
13. Changes to these terms
We may update these terms from time to time. The latest version will always be on this page with its effective date. Continued use of the website after changes take effect means you accept the updated terms.
